These Terms and Conditions set out the basis on which Rubbish Collection Camberwell provides rubbish collection and waste removal services. By booking our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing an order with us.

1. Definitions

In these Terms and Conditions, the following words have the meanings given below:

1.1 "Company" means Rubbish Collection Camberwell, the provider of rubbish collection and waste removal services.

1.2 "Customer" or "you" means any individual, business, landlord, agent or organisation that requests or receives services from the Company.

1.3 "Services" means rubbish collection, waste removal, bulky waste clearance, household or commercial waste collection, and any related services provided by the Company.

1.4 "Waste" means any rubbish, refuse, junk, unwanted items or materials presented by the Customer for collection and disposal, subject to applicable waste regulations.

1.5 "Contract" means the agreement between the Company and the Customer for the supply of Services, formed when a booking is accepted by the Company.

2. Scope of Services

2.1 The Company provides rubbish and waste collection services for domestic and commercial customers within its designated service areas. Services may include general rubbish collection, removal of bulky items, garden waste removal and light commercial waste collections, subject to availability and capacity.

2.2 The exact scope of Services, including the type and amount of waste to be collected, the collection location, and the date and time window, will be agreed at the time of booking.

2.3 The Company reserves the right to refuse collection of any waste that is prohibited by law, unsafe to handle, incorrectly described, or in the Company’s reasonable opinion may pose a risk to health, safety, property or the environment.

3. Booking Process

3.1 Bookings may be made by telephone or other communication methods made available by the Company. All bookings are subject to availability and confirmation by the Company.

3.2 When you place a booking request, you will be asked to provide accurate information including your name, contact details, collection address, access details, description and approximate volume or weight of the waste, and any relevant restrictions such as parking or time limitations.

3.3 The Company will provide an estimated price based on the information supplied. This estimate may be adjusted on site if the actual volume, weight, type or location of the waste differs from the original description, provided that any change in price is agreed with you before the work is carried out.

3.4 A Contract is formed when the Company confirms the booking and you accept the quoted price and proposed collection time. Confirmation may be provided verbally or in writing.

3.5 The Customer is responsible for ensuring that all information provided at the time of booking is complete and accurate. The Company will not be liable for delays, additional charges or failed collections resulting from inaccurate or incomplete information.

4. Access and Customer Responsibilities

4.1 The Customer must ensure that the Company has safe and suitable access to the collection point at the agreed time. This includes arranging necessary permissions or permits for access, parking, loading and unloading where required.

4.2 Waste must be presented in a manner that is reasonably accessible, safe to handle and ready for collection. Where bags or containers are used, they should be of adequate strength and securely closed.

4.3 The Customer must inform the Company in advance of any factors that may affect access or collection, such as restricted parking zones, vehicle height limits, security gates, time-controlled access, or hazardous conditions on site.

4.4 If the Company’s operatives consider that access is unsafe or substantially different from what was described at the time of booking, the Company may refuse to carry out the collection or may agree an additional charge for extra work, waiting time or additional personnel or equipment.

4.5 The Customer is responsible for obtaining any consents required from landlords, managing agents, neighbours or other third parties to facilitate the Company’s access to the collection point.

5. Waste Regulations and Prohibited Items

5.1 The Company operates in accordance with applicable UK waste management legislation and regulations. All waste collected will be transported and disposed of at authorised facilities in a lawful and responsible manner.

5.2 The Customer agrees not to present any waste that is classified as hazardous or special waste unless this has been expressly agreed in advance with the Company. Prohibited items may include, but are not limited to: asbestos, clinical or medical waste, chemicals, solvents, oils, petrol, gas bottles, explosives, fireworks, radioactive materials, certain electrical items such as fridges containing refrigerant gases, and any waste requiring specialist handling.

5.3 If prohibited or hazardous items are found within the waste after collection has taken place, the Customer may be liable for additional charges, including any fees, penalties or costs incurred by the Company in handling, returning or lawfully disposing of such items.

5.4 The Customer warrants that all waste presented for collection is owned by the Customer or that the Customer has full authority from the owner to arrange removal and disposal.

5.5 The Customer must not mix waste types where this is prohibited by law or regulation. Where separate streams are required, the Customer must follow any reasonable instructions provided by the Company.

6. Pricing and Payment

6.1 Prices are normally based on the volume or weight of waste collected, the type of materials, ease of access, location within the service area, and any additional labour or services required.

6.2 Any price provided before the collection is an estimate based on the information supplied. The final price may be adjusted on site once the actual waste and working conditions have been assessed. The Customer will be informed of any change before work proceeds.

6.3 Unless otherwise agreed, payment is due on completion of the collection. The Company may accept payment by cash, debit or credit card, bank transfer or other methods notified to the Customer.

6.4 For business customers and account holders, the Company may issue invoices payable within an agreed period. Payment terms will be stated on the invoice. The Company reserves the right to charge interest and reasonable recovery costs on overdue invoices in accordance with applicable law.

6.5 The Company may require a deposit or full prepayment at the time of booking, particularly for larger collections or commercial work. Any such requirement will be communicated before the Contract is formed.

6.6 Prices are quoted inclusive or exclusive of VAT depending on the Company’s VAT status, which will be made clear at the time of booking. Where VAT is chargeable, it will be added at the prevailing rate.

7. Cancellations and Amendments

7.1 The Customer may cancel or amend a booking by contacting the Company directly. Cancellations or changes are only effective when acknowledged by the Company.

7.2 If the Customer cancels a booking with sufficient notice, any prepayments may be refunded at the Company’s discretion, subject to any non-refundable costs incurred. The Company will make reasonable efforts to keep such costs to a minimum.

7.3 The Company reserves the right to charge a cancellation fee if a booking is cancelled at short notice, or if the Customer fails to provide access at the agreed time, resulting in a wasted journey. Such fee may reflect travel time, labour costs and lost opportunity.

7.4 If the Customer wishes to change the date, time or scope of the Services, the Company will use reasonable endeavours to accommodate the request, but cannot guarantee availability. Additional charges may apply where changes increase the cost of providing the Services.

7.5 The Company may cancel or reschedule a booking due to circumstances beyond its reasonable control, including vehicle breakdown, staff illness, adverse weather, accidents, access restrictions or compliance with legal or regulatory obligations. In such cases, the Company will notify the Customer as soon as reasonably practicable and arrange an alternative date or refund any prepayments for Services not provided.

8. Performance of Services

8.1 The Company will carry out the Services with reasonable care and skill and in accordance with applicable laws and recognised industry standards for rubbish and waste collection.

8.2 Collection times are given as estimates or time windows. While the Company will make reasonable efforts to arrive within the agreed period, timing is not guaranteed and may be affected by traffic, weather, access, earlier jobs or other factors beyond the Company’s control.

8.3 If the Company is delayed or unable to attend at the agreed time, it will use reasonable efforts to notify the Customer and provide an updated time where possible.

8.4 The Company’s operatives will only remove waste that has been clearly identified for collection. The Customer is responsible for ensuring that any items not intended for disposal are kept separate.

9. Damage and Liability

9.1 The Company will take reasonable care when carrying out the Services to avoid damage to property, fixtures and fittings. However, the Customer should take appropriate precautions by protecting surfaces, removing fragile items and providing clear routes for the removal of waste.

9.2 The Company will not be liable for any pre-existing damage or for damage that occurs as a result of defective structures, weak surfaces, poor access, or the inherent risk of moving large or heavy items where reasonable care has been exercised.

9.3 If the Customer believes that the Company has caused damage, the Customer must notify the Company as soon as reasonably practicable, providing full details and any supporting evidence. The Company will investigate and, where it is found to be at fault, may at its discretion arrange repair, replacement or a reasonable compensation payment.

9.4 Nothing in these Terms and Conditions limits or excludes the Company’s liability for death or personal injury caused by its negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited.

9.5 Subject to the above, the Company’s total liability arising out of or in connection with any Contract shall not exceed the total price paid or payable for the relevant Services.

9.6 The Company will not be liable for any indirect or consequential loss, including loss of profit, loss of business, loss of opportunity or loss of goodwill, arising from or in connection with the provision of the Services.

10. Customer Warranties and Indemnity

10.1 The Customer warrants that all information provided in connection with any booking is true, complete and not misleading.

10.2 The Customer warrants that they have full authority to arrange the removal of the waste and that the waste presented does not contain prohibited or hazardous materials unless expressly agreed.

10.3 The Customer agrees to indemnify the Company against any claims, losses, damages, costs, fines or expenses arising from a breach of these warranties, or from any unlawful, unsafe or improper presentation of waste by the Customer.

11. Complaints

11.1 If you are dissatisfied with any aspect of the Services, you should notify the Company as soon as possible so that it has an opportunity to address your concerns.

11.2 The Company will investigate all complaints in a fair and timely manner and will use reasonable efforts to resolve issues by re-performing Services where appropriate or offering a reasonable remedy.

12. Data Protection

12.1 The Company may collect and process personal data relating to the Customer for the purposes of managing bookings, providing Services, processing payments, and complying with legal obligations.

12.2 The Company will handle personal data in accordance with applicable UK data protection laws and will take reasonable steps to keep such data secure and confidential.

13. Variations to Terms

13.1 The Company may update or amend these Terms and Conditions from time to time. Any changes will apply to new bookings made after the updated Terms and Conditions have been issued or made available.

13.2 The Terms and Conditions in force at the time of your booking will apply to your Contract unless otherwise agreed in writing.

14. Severability

14.1 If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable by any court or competent authority, that provision shall be severed from the remaining provisions, which will continue in full force and effect.

15. Governing Law and Jurisdiction

15.1 These Terms and Conditions, and any Contract between the Company and the Customer, are governed by and shall be construed in accordance with the laws of England and Wales.

15.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to resolve any disputes arising out of or in connection with these Terms and Conditions or any Contract for rubbish collection and waste removal services.
